Öz

Is Sagligi ve Güvenligi Kanununun 19. maqdesinde çalisanlarin, is sagligi ve güvenligi konu­sunda alinan her türlü önleme uymakla yükümlü oldugu öngörülmüstür. TBK'.nin 400. maddesine göre, isçi isverene kusuruyla verdigi he.r türlü zarardan sorumludur. Sorumlulugun belirlenmesin­de; isin tehlikeli olup olmamasi, uzmanligi ve egitimi gerektirip gerektirmemesi dikkate alinacak­tir. Ayrica isçinin isveren tarafindan bilinen veya bilinmesi gerekli yetenek ve nitelikleri de göz önünde tutulacaktir (m. 400/ID. Diger taraftan, isçinin kendi istemesi veya ihmali yüzünden isin güvenligini tehlikeye düsüm1esi, isveren için hakh bir fesih nedenidir (Is K.m. 25/ll-i). Çalisma­mizin amaci, çalisanlarin yükümlülükleri ve yükümlülüklere uyulmamasinin hukuki sonuçlarinin incelenmesidir.

Employees' Responsibilities within the scope of Occupational Health and Safety Act No. 6331 and Legal Consequences of Their Adverse Behaviors


Abstract

Article 19 of Occupational Health and Safety Act No. 6331 states thal employees are obligared ro follow ali of these measures and precautions that were taken to ensure their occupational health and safery at the workplace. According to the Article 400 of Turkish Law of Obligations, it is adjudicated that employees are accountable for any damage that they cause to employers because of their failure to comply with the measures and precautions that were taken to ensure their occupational health and safery ar rhe workplace (Article 499/I). Whether the job is dangero­us, employees need to be an experi: on it or a training is needed will be taken into consideration to detennine the responsibilities for any darnage caused by ernployees' failure to comply with the measures and precautions. Also, ehe employee's skills and qualifications, that the employer knows or should know, will be considered (Article 400/II). On ehe other hand, the employee's own negligence or failure to comply with the measures and precautions puts ehe safery ar ehe workplace in danger and this is a legitimate reason for the employer to defeasance (Labor Law, Article 25/II-i). The purpose of mir study is to examine employees' responsibilities within the scope of OccupationaJ Health and Safety Act No. 6331 and the legal consequences of failure co comply wi.th these responsibilities.
