Öz

Türk Medeni Kanunu’nun 1. Maddesinin 1. Fikrasina göre “Kanun, sözüyle ve özüyle degindigi bütün konularda uygulanir.” Ögretide ve yargi kararlarinda da kabul edildigi gibi kanunun özünün (ruhunun) arastirilmasi kanun amacinin belirlenmesini gerektirir. Bu nedenle “isçi lehine yorum” is iliskilerinde her durumda basvurulacak bir yorum yöntemi degildir. Is hukuku kuralinin amaci belirlenemiyorsa, o takdirde is mevzuatinin tümünün genel amacindan hareketle isçi lehine yoruma basvurulabilir. Zamana göre objektif (amaca uygun) yorum, yorum yapilan zamanin kosul ve ihtiyaçlarina göre yorum yapilmasina imkân tanidigindan is yasasi kuralinin gerçek amacinin belirlenmesinde etkili bir yorum yöntemidir.

EXPEDIENT INTERPRETATION IN LABOUR LAW


Abstract

According to the fi rst paragraph of fi rst article of Turkish Civil Code; “The law shall be applicable to all the issues where it refers with its wording and substantiality.” As it’s accepted in doctrine and case law, the search for substantiality (spirit) of the law requires the identifi cation of its purview. In this regard, “interpretation in favour of the worker” is not an interpretation method to refer in every condition in labour relations. If the purview of the labour rule cannot be identifi ed, then “interpretation in favour of the worker” could be applicable, with reference to the general purview of the whole labour legislation. Allowing to interprete according to the conditions and needs of the time the interpretation is made; up to date objective (expedient) interpretation is an effective method for identifi - cation of the real purview of the labour law provision.
