Hukukumuzda çalisanlara sendika kurma ve sendikaya üye olma hakkinin taninmasinin yaninda pozitif sendika özgürlügünün korunmasi amaciyla birtakim sendikal güvenceler hüküm altina alinmistir. Konuya iliskin hükümlere hem 6356 sayili Sendikalar ve Toplu Is Sözlesmesi Kanunu hem de 4688 sayili Kamu Görevlileri Sendikalari ve Toplu Sözlesme Kanunu'nda yer verilmis ve çalisanlar isverenlerine karsi korunmuslardir. Çalisma konumuz açisindan sadece 4688 sayili Kanun kapsamindaki düzenlemelerden bahsedilecek olup ilgili yerlerde 6356 sayili Kanun'daki hükümlere atif yapilacaktir. Bu kapsamda öncelikle m. 18'deki sendika üyelerinin ve yöneticilerinin güvencesi konusu ele alinacak, ardindan da m. 23'teki isyeri sendika temsilcilerinin güvencesinden bahsedilecektir.

Alongside the recognition of the right to establish trade unions and become union members in Turkish legal system, certain union guarantees have been enshrined to protect positive union freedom. Provisions related to this matter are included in both Law No. 6356 on Trade Unions and Collective Bargaining Agreements, as well as Law No. 4688 on Public Officials' Trade Unions and Collective Agreements, ensuring protection for employees against employers. For the purpose of our study, we will only discuss the regulations within the scope of Law No. 4688, with references made to the provisions in Law No. 6356 where relevant. Within this framework, firstly, the subject of guarantees for union members and executives in Article 18 will be addressed, followed by the discussion of the guarantees for workplace union representatives in Article 23.
