6772 sayili Kanun’a göre kamu kurumlari ile bunlarin sermayesinin yarisindan fazlasina sahip olduklari sirketlerde çalisan isçilere her yil birer aylik istihkaklari tutarinda bir ikramiye ödenecektir. Bu baglamda 6772 sayili Kanun kapsamina giren isyerlerinin tespiti önem arz etmektedir. 6772 sayili Kanun’a göre ilave tediye saglanmasinin kapsami kanunla kurulan, kamusal yetki kullanan kamu kurum ve kurulusu niteligindeki isletmeler ile sinirlidir. Belediye sirketleri kanunla kurulmadigi, kamusal yetki kullanmadigi ve 6772 sayili Kanun’daki belediyeye bagli kurulus niteliginde olmadiklari için isçileri ilave tediyeden yararlanamaz.

According to the Law no: 6772, employees of public institutions and the companies with more than half of their capital belongs to public institutions will receive additional remuneration for one month of each year. In this context, it is important to determine the workplaces that is in the scope of the Law No. 6772. The scope of providing additional payments in accordance with Law No. 6772 is limited to state institutions and organization that established by law and use public authority. Employees of municipal incorporations can not take advantage of additional payment, because municipal incorporations are not established by law, do not use public authority and do not have the characteristics of municipal affiliate.
