Yaslilik ayligina hak kazanabilmek için aranan sartlar her ne kadar sigortalinin ilk kez sigortali oldugu tarihe ve aylik talep edilen tarihteki hukuki statüsüne göre degismekteyse de, kidem tazminatinin hak kazanilmasina olanak taniyan 1475 sayili Kanun m.14/I,(5) hükmü uygulamada adeta “15 yil sigortalilik süresi ve 3600 gün prim ödeme” olarak formüle edilmekte ve bu sartlarin yaninda çalisma süresine iliskin sarti da saglayan isçinin, anilan nedenle sözlesmeyi feshetmesi halinde kidem tazminatina hak kazanacagi kabul edilmektedir. Çalismamizda yaslilik ayligina hak kazanma sartlarini düzenleyen yürürlükteki hükümler karsisinda 1475 sayili Kanun m.14/I,(5) düzenlemesinin “15 yil sigortalilik süresi tamamlama ve 3600 gün prim bildirme” sarti olarak ele alinmasinin isabetli olup olmadigi ve hizmetlerin birlestirilmesi durumunda kidem tazminatina hak kazanma sartlarinin, farkli hukuki statüye göre öngörülen yaslilik ayligina hak kazanma sartlari dogrultusunda sekillenip sekillenmeyecegi konulari üzerinde durulmustur.

Although the conditions regarding to be entitled to retirement pension differentiate according to the date of the insured first admission to the retirement pension insurance and his legal status at the date of his demand of first retirement pension payment; article 14/I, (5) of the Code numbered 1475 enabling the entitlement to severance pay is formulating in the application as “15 years of retirement pension coverage and 3600 days of paid premium” and it is accepted that in case of the termination of the contract of by the employee fulfilling these conditions along with the condition on the time of working, the employee would be entitled to severance pay. In our paper, the subjects that whether it is appropriate to understand the article 14/I, (5) of the Code numbered 1475 enabling the entitlement to severance pay as a condition of “15 years of retirement pension coverage and 3600 days of paid premium” in the light of the provisions in vigor and whether the conditions on the entitlement of severance pay in case of the unification of the services could be assessed in the light of the conditions entitling retirement pension according to the legal status would be discussed.
