Is Kanunu’nun m.25/I-(b) hükmünde, isçinin tedavi edilemeyecek nitelikte bir hastaliga yakalandigi ve isyerinde çalismasinda sakinca bulundugunun saglik kurulunca saptanmasi halinde isverene hakli nedenle fesih yetkisi taninmistir; hakli fesih için isçinin ayrica belirli bir süre ise devamsizlik yapmis olmasi sarti aranmaz. Is Kanunu’nun 25/I-b bendindeki saglik nedenleri söz konusuysa fesihten önce isçiden savunma alma zorunlulugu da yoktur. 6331 sayili Is Sagligi ve Güvenligi Kanunu’nun yürürlüge girdigi 2012 yilindan sonra artik isyeri hekiminin “isçinin isyerinde çalismasinda sakinca bulunduguna” iliskin verecegi saglik raporu, Is Kanunu’nun m.25/I-b bendi kapsamindaki hakli fesih için yeterli görülmelidir. Is Kanunu’nun 25/I-b bendinde bu yönde yapilacak bir degisiklikle bu husustaki duraksamalar ortadan kaldirilabilecektir.

According to Article 25/I-b of Labour Act No. 4857, the employer is entitled to terminate the contract for just cause, in the condition if the Health Commitee determines employee’s disease as incurable and his/her working in the workplace shall be risky. In this case, the condition of employee’s absenteeism for a determined period shall not be required for termination by just cause. Besides, if the reasons of health that are mentioned in Article 25/I-b of Labour Act are in question, the employer is not obliged to get employee’s defense statement before termination. After the entry into force of Act No. 6331 on Occupational Health and Safety in 2012, medical report given by the occupational physician determining “the empoyee’s working in the workplace is risky” should be considered adequate for the termination of just cause in the context of Article 25/I-b of Labour Act. The reservations concerning this issue could be abolished after the amendments that shall be made in this context in Article 25/I-b of Labour Act.
