Türk is hukukunda ulusal bayram ve genel tatil günlerinin hangileri oldugu 2429 s. Ulusal Bayram ve Genel Tatil Ücretleri Hakkinda Kanunda düzenlenmistir. Kural olarak isçinin belirtilen kanunda sayilmis olan ulusal bayram ve genel tatil günlerinde ücretinde herhangi bir kesinti yapilmaksizin çalismamasi esastir. Ancak toplu is sözlesmesi veya is sözlesmesinde kararlastirilmissa veya isçinin onayi varsa belirtilen günlerde çalisabilecek ve bunun karsiliginda kanunen iki günlük ücrete hak kazanmaktadir. Uygulamada ulusal bayram ve genel tatil günlerinde çalisan isçilere, bu çalismalarin karsiliginda serbest zaman ya da sonraki is günlerinde kullanmak üzere izin verildigi görülmektedir. Yargitay’in 9. HD’nin 15.01.2018 tarihli kararinda belirtildigi gibi ulusal bayram ve genel tatil günlerinde çalismanin karsiliginin serbest zaman ya da izinle yerine getirilmesi mümkün degildir.

At Turkish Labour Law national holiday and public holidays are in 2429 p. National Holiday and Public Holidays Code. As a rule, it is essential that the employee doesn’t work without any deduction from his wages on national holidays and public holidays, which are listed in this Code. However, if the collective bargaining agreement or the employment contract is agreed or if the employee has the approval, the employee will be able to work on the specified days and in return, is entitled to two-days pays. In practice, it is seen that employees working on national holidays and public holidays are allowed to use free time on working days witbuhout any payment. As it is indicated rightfully in the Supreme Court’s verdict of 15 January 2018; it is not legally possible to compensate the work with free time on national holidays and public holidays without any payment. The provision of this working can be paid only with additional daily wage as stated at the Turkish Labour Code.
