Vekâlet sözlesmesi, 6098 sayili Türk Borçlar Kanunu’nda yer verilen isgörme sözlesmelerindendir. Bu sözlesme hükümlerinin, ayni zamanda, Kanun’da düzenlenmeyen isgörme sözlesmelerine de uygulanacagi öngörülmüstür. Vekâlet sözlesmesinin bu denli kapsayici bir sekilde düzenlenmis olmasi, onun diger isgörme sözlesmelerinden ayirt edilebilmesini güçlestirmektedir. Oysa taraflar arasindaki hukuki iliskinin dogru bir biçimde nitelendirilmesi, özellikle de sözlesmenin sona ermesine baglanan sonuçlar bakimindan büyük önem tasimaktadir. Çalismamizda vekâlet sözlesmesinin genel özelliklerine deginilmis ve is sözlesmesinin unsurlarinin yol göstericiliginde yargi kararlarindan da yararlanilarak her iki sözlesme arasindaki benzerlik ve farkliliklarin ortaya konulmasina gayret edilmistir

The mandate contracts are among the service contracts regulated in the Turkish Code of Obligations No. 6098. It is prescribed that the provisions of such contracts shall also apply to the service contracts that are not regulated in the Code No. 6098. Such wide inclusivity of the mandate contracts makes it difficult to differentiate them from other service contracts. However, defining the legal relationship between the parties correctly is very important particularly in terms of the consequences that are linked to the termination of the contract. In our study, we have noted the general attributes of the mandate contracts and aimed to set forth the similarities and differences between the mandate and employment contracts in the guidance of the elements of employment contracts by also benefiting from the judicial decisions.
