4857 Sayılı Kanun’un 7555 Sayılı Kanun’la Değişik 109. Maddesinde Öngörülen Yazılı Şekil Kuralı Fesih Bildirimi İçin Geçerlilik Şartı Mıdır?-Bir Yasal Düzenleme Önerisi

Öz

4857 sayılı Kanun’un 109. maddesinde 20.07.2025 tarih ve 7555 sayılı Kanun’la değişiklik yapılmadan önceki metninde Kanunda öngörülen bildirimlerin yazılı yapılması gerektiği düzenlenmişti. Maddenin gerekçesinde kuralın ispat şartı olduğu belirtildiğinden uygulama bu yönde gelişmişti. 7555 sayılı Kanun’la yapılan değişikle maddenin birinci fıkrasında yer verilen “İş sözleşmesinin feshi sonucunu doğuracak bildirimler her hâlde yazılı yapılır.” cümlesi öngörülen şeklin niteliği konusunda tartışmalara yol açmıştır. Hükümde yer alan şekil kuralının geçerlilik şartı olarak kabul edilmesi durumunda, yazılı şekilde yapılmayan fesih bildiriminin geçersiz sayılması önemli hukuki sonuçlar doğurmakta; bu çerçevede, geçersiz fesihte bulunan tarafın temerrüde düşmesi ile haksız fesih hükümlerinin uygulanması ihtimalleri gündeme gelmektedir. Düzenlemenin hem işçi hem de işveren açısından süreli ve derhal fesih bildirimlerini kapsaması, konunun önemini daha da artırmaktadır. Bu çalışmada, yeni düzenlemenin geçerlilik şartı niteliği taşıyıp taşımadığı; bu niteliği haiz olduğunun kabulü hâlinde, yazılı şekilde yapılmayan fesih bildiriminin iş sözleşmesinin varlığı üzerindeki etkileri ve sonuçları öğreti ve yargı kararları çerçevesinde incelenmiştir. Ayrıca, konuya ilişkin bir yasal düzenleme önerisi de çalışmanın başlıca inceleme alanlarından birini oluşturmaktadır.

Is the Written Form Requirement Under Article 109 of Labour Law No. 4857, as Amended by Law No. 7555, a Validity Condition for Termination Notice? -A Legislative Proposal-


Abstract

According to Article 109 of Law No. 4857, as amended by Law No. 7555 dated July 20, 2025, written notifications registered in the law could be re-decorated. Since the rationale for the article stated that this rule constituted a condition of proof, practice developed accordingly. The amendment made by Law No. 7555, which included the sentence “Notifications resulting in the termination of an labour contract shall in all cases be made in writing” in the first paragraph of the article, has led to discussions regarding the nature of the prescribed form. If the form rule in the provision is accepted as a condition of validity, the invalidity of a termination notice not made in writing has significant legal consequences; in this context, the possibility of the party making the invalid termination being in default and the application of unfair termination provisions arises. The fact that the regulation covers both fixed-term and immediate termination notices for both employees and employers further increases the importance of the issue. This study examines whether the new regulation constitutes a condition of validity; assuming that this characteristic is present, the effects and consequences of a non-written termination notice on the existence of the labour contract have been examined within the framework of doctrinal opinions and judicial decisions. Furthermore, a proposed legal regulation on the subject constitutes one of the main areas of this study.
