İşsizlik sigortası ve onun normatif çatısı altında yer alan işsizlik ödeneği, sosyo-ekonomik bir kavramdır. Bu kavram, iş ve sosyal güvenlik hukukunun en değişkenli yapılarından birini teşkil eder. Onun bu durumunun sebebi, bileşiminde yer alan ekonominin ağırlıklı bir unsur taşımasıdır. İç hukukumuza 4447 s. Kanun’la giren bu kavramın, yabancı hukuklarla karşılaştırıldığında da kapsam, işsizlik ödeneğinden yararlanma koşulları ve yararlanma süresi açısından yetersizliği açıktır. Bu konuda Devletin katkı payının belirlenmesinde Anayasa’nın 65. maddesinde yer alan “mali kaynakların yeterliliği” ölçütü elbette önemli bir parametredir. Zorunlu sigorta sisteminin iç hukuktaki önemi açık olmakla birlikte, İşsizlik Sigortası Fonu’na yatırılan primlerin rasyonel kullanımının her şeye rağmen sistemi rahatlatacağı düşüncesindeyiz.

Unemployment insurance and the unemployment benefits provided under its regulatory framework constitute a socio-economic concept. It represents a structure that is perhaps the most variable aspect of labor and social security law. This is due to the fact that the economy constitutes a predominant element within its composition. When compared to foreign legal systems, this concept introduced into our domestic law by Law No. 4447 is clearly insufficient in terms of scope, eligibility conditions for unemployment benefits, and the duration of benefits. However, regarding the determination of the State’s contribution share, the criterion of “sufficiency of financial resources” set forth in Article 65 of the Constitution is a significant parameter. While the importance of the mandatory insurance system under domestic law is clear, we believe that the rational use of premiums contributed to the Unemployment Insurance Fund would, despite everything, alleviate the strain on the system.
